Welcome to Forte. These Terms & Conditions (“Terms”) govern your access to and use of the Forte mobile application, website, and related services (the “Platform”), operated by Forte Technologies Group LLC (“Forte,” “we,” “us,” or “our”).

Some services available through Forte (e.g., Concierge, Seller Support, Transaction Advisory) are provided by Forte Services LLC, under a management agreement with Forte Technologies.

By applying for membership, browsing listings, or using any part of the Platform, you agree to these Terms.

1. LEGAL ENTITIES & SERVICE SCOPE

  • Forte Technologies Group LLC is a Delaware entity that owns and operates the digital platform, applications, and all intellectual property.
  • Forte Services LLC, a California-based entity, delivers operational and transactional services to members who request on-demand Concierge support.

You may interact with one or both entities depending on your use of the platform.

2. ELIGIBILITY & MEMBERSHIP

  • You must be at least 18 years old to use Forte.
  • Membership is subject to approval. Forte reserves the right to accept or reject any application at our sole discretion.
  • We may request documentation to verify identity or vehicle ownership as part of the vetting process.
  • Forte is currently available to U.S.-based users. International expansion may be announced at a later time.

3. PLATFORM ACCESS

  • Access to certain features (e.g., public profiles, insights data, Concierge) requires an active Forte membership.
  • Forte reserves the right to update, restrict, or discontinue features at any time without notice.
  • Users may not share accounts, impersonate others, or use the Platform on behalf of someone else.

4. TRANSACTIONS & CONCIERGE SERVICES

  • Concierge services are facilitated by Forte Services LLC.
  • By engaging with our concierge, you are entering a service relationship with Forte Services LLC.
  • Forte Technologies Group LLC is not liable for delays, disputes, or outcomes of any concierge transactions or advisory recommendations.
  • All buyer and seller support is handled via Forte’s Concierge Services.
  • Concierge Fees:
    • Buying: 1% of vehicle value
    • Selling: $250 flat fee
    • Other Services (e.g., financing, insurance, transport): $50 per request
  • Fees are non-refundable once a request is initiated and accepted by Forte. In case a transaction cannot be executed for circumstances outside the members control Forte will refund the member.
  • Forte is not a dealer, broker, or party to any final transaction between users and external buyers/sellers happening without Concierge Services involvement from start to finish.
  • You are solely responsible for legal compliance in any transaction, including taxes, paperwork, and local regulations.

5. USER-GENERATED CONTENT

  • You retain ownership of any content you submit (e.g., Garage entries, car photos, comments), but grant Forte a non-exclusive, royalty-free license to use, display, and share that content within the platform.
  • You must have all necessary rights to any content you upload. Do not upload copyrighted, trademarked, or confidential material without permission.

6. COMMUNITY CONDUCT

See the “User Policy” section above for full details.
Violations of our conduct standards may result in temporary or permanent removal from the platform with no refund.

7. INTELLECTUAL PROPERTY

  • All logos, designs, databases, software, and brand assets are the property of Forte Technologies Group LLC.
  • You may not reverse-engineer, scrape, clone, or reproduce any part of the Platform without express written consent.

8. DISCLAIMERS & LIMITATIONS OF LIABILITY

  • Forte provides the Platform “as is” without warranties of any kind, express or implied.
  • We do not guarantee the accuracy, quality, or authenticity of listings, users, or vehicles on the Platform.
  • Forte is not liable for any loss, damage, fraud, or disputes that arise from transactions between members or with third parties.
  • Our total liability under these Terms will not exceed the amount paid by you (if any) for membership or Concierge services in the prior 12 months.
  • Forte Technologies Group LLC is not responsible for any loss or damage resulting from services performed by Forte Services LLC or any third-party provider.
  • Forte Services LLC assumes responsibility for the performance of any Concierge-related deliverables.

9. INDEMNIFICATION

You agree to indemnify and hold harmless Forte, its affiliates, employees, and agents from any claims, losses, or damages arising from:

  • Your misuse of the Platform
  • Your violation of these Terms
  • Any transaction you enter into via the Platform

10. CHANGES TO TERMS

We may modify these Terms from time to time. Material changes will be communicated to members via email or in-app notification. Continued use of Forte after such changes constitutes acceptance.

11. TERMINATION

  • You may cancel your membership at any time via your Account Settings.
  • Forte may suspend or terminate your account for violating these Terms or engaging in behavior that harms the community.
  • No refunds are issued for early cancellation or suspension due to policy violations.

12. GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of the State of [Insert State], without regard to conflict of law principles.
Any disputes shall be resolved via binding arbitration in [Insert County, State], unless otherwise mutually agreed.

Privacy Policy

Forte (“we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, and protect your personal information when you use our mobile application, website (fortemembers.com), and related services (together, the “Platform”).

Certain operational services, including our auto concierge, are provided by Forte Services LLC under a management agreement with Forte Technologies.

b. Vehicle Information

  • VIN, make/model, ownership documents, service records
  • Purchase price, purchase date, estimated value

c. Usage Data

  • App usage behavior, page views, saved cars, Garage interactions
  • Communication logs (e.g., chats with Concierge or other members)

d. Device & Technical Data

  • IP address, browser type, device model, operating system
  • Location data (if permission is granted)

2. HOW WE USE YOUR INFORMATION

We use your data to:

  • Verify your identity and approve your membership
  • Facilitate transactions and concierge requests
  • Help you build and manage your digital garage
  • Connect you with listings, dealers, and members that match your interests
  • Provide insights, market data, and portfolio performance
  • Detect fraud and maintain platform security
  • Comply with legal obligations

We do not sell your personal information.

3. SHARING YOUR INFORMATION

We may share your data with:

  • Verified Dealers to facilitate a car transaction you’ve requested
  • Service providers (e.g., cloud hosting, payment processors, verification tools)
  • Analytics platforms to improve our product
  • Law enforcement or regulators if legally required

4. YOUR PRIVACY CONTROLS

You can:

  • View and update your profile
  • Choose to keep your Garage private or public
  • Request access, correction, or deletion of your data
  • Opt out of marketing emails at any time

We take reasonable measures to protect your information from unauthorized access. Data is encrypted in transit and at rest. We retain your information as long as your account is active or as required by law.

6. CHILDREN’S PRIVACY

Forte is not intended for individuals under the age of 18. We do not knowingly collect data from minors.

7. INTERNATIONAL USERS

Currently, Forte is only available to users located in the United States. If this changes, we will update this policy accordingly.

8. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time. If changes are material, we will notify you via email or app notification.

Cookies & tracking pixels

We use cookies, pixels, and similar technologies to enhance your experience on Forte.

a. What We Use:

  • Essential Cookies – Enable core functionality such as secure login and session management.
  • Performance & Analytics Cookies – Help us understand how users interact with the app and website (e.g., page views, tap behavior, errors).
  • Marketing Pixels – We may use tracking pixels (such as Meta/Facebook Pixel or Google Ads tags) to measure ad performance and optimize campaigns, including referral programs.

b. Why We Use Them:

  • To keep you logged in and provide seamless navigation
  • To improve app functionality and performance
  • To measure interest in specific features or services (e.g., Concierge, Garage, Listings)
  • To attribute membership referrals and track influencer/club partner performance

c. Your Options:

  • You can control or disable cookies via your browser settings.
  • Most mobile devices allow you to control tracking in your privacy settings.
  • Opting out may affect functionality or personalization of the platform.

We do not use cookies to sell your data to third parties.

User Policy

By accessing or using Forte, you agree to abide by the following rules and responsibilities. These terms apply to all members, whether you're browsing, buying, selling, or engaging with the community.

1. MEMBER CONDUCT

You agree to:

  • Use Forte only for lawful purposes and in accordance with these Terms.
  • Provide accurate, current, and complete information during the application and onboarding process.
  • Treat other members with respect and professionalism.
  • Maintain confidentiality of any private information shared within the platform (e.g., off-market listings, private garages, or member profiles).
  • Only upload cars to your Garage that you own or have permission to represent.
  • Follow all applicable laws, including those related to car transactions, financing, title ownership, and taxes.

2. PROHIBITED BEHAVIOR

You may not:

  • Misrepresent your identity, vehicle ownership, or transaction intent.
  • Spam, solicit, or message other members for non-Forte-related business purposes.
  • Use Forte to promote or sell services, businesses, or vehicles outside of the approved listings and concierge flow.
  • Attempt to circumvent Forte’s Concierge or brokered services to avoid fees.
  • Post or share false, misleading, or unlawful content.
  • Use bots, scrapers, or automated tools to access or copy data from Forte.
  • Engage in harassment, fraud, threats, or any activity that disrupts the platform or other users' experience.

3. ACCOUNT SUSPENSION & REMOVAL

We reserve the right to suspend or terminate any user account at our sole discretion if we believe:

  • You violated this User Policy or our Terms of Service;
  • Your behavior creates legal risk, reputational damage, or harm to other users;
  • You abuse platform features or attempt to misuse the membership vetting system.

No refunds will be issued for terminated memberships due to a violation of this User Policy.

4. COMMUNITY STANDARDS

Forte is a vetted community built on trust, transparency, and shared passion. To preserve this culture, we expect all members to:

  • Participate in good faith.
  • Report suspicious or inappropriate behavior.
  • Use the Garage, Watchlist, and Index features with discretion and integrity.
  • Respect any limitations set by members with private profiles.
